1. General
These Terms & Conditions govern all purchases, deliveries, and services provided by Cloverdale Topsoil Ltd. (“we”, “us”, “our”). By placing an order, requesting a quote, or using our services, you agree to the terms outlined below.
2. Products & Availability
All materials including topsoil, sand, gravel, mulch, and related products are subject to availability. We reserve the right to substitute materials of equal or greater quality where necessary.
Product descriptions are provided for general guidance. Variations in color, texture, and composition may occur due to the natural nature of materials.
3. Pricing
All prices are subject to change without notice.

Prices listed are typically per cubic yard unless otherwise stated

Delivery fees are calculated based on location and order size

Bulk pricing may apply to larger orders and is provided upon request
Final pricing will be confirmed at the time of order or quote approval.
4. Orders & Payment
Payment must be made in full prior to delivery unless otherwise agreed in writing.

E-transfers

Other approved payment methods
By submitting payment, you authorize Cloverdale Topsoil Ltd. to process the transaction for the agreed amount.
5. Bulk Orders & Custom Quotes
Orders exceeding certain quantities (e.g., 10+ yards) may require custom pricing and scheduling.
Bulk orders:

Are subject to availability of larger trucks

May require additional coordination

Must be confirmed by our team prior to delivery
6. Delivery Terms
Delivery is provided to the address entered at checkout or confirmed during ordering.
By placing an order, you agree that:

The delivery location is accessible and safe for our trucks

You have provided accurate delivery instructions

You accept responsibility for any surface damage (e.g., driveways, curbs, landscaping) caused during delivery
Our drivers will make reasonable efforts to place materials as requested, but final placement is at driver discretion based on safety conditions.
7. Missed Deliveries & Access Issues
If delivery cannot be completed due to:

Restricted access

Unsafe conditions
-
Incorrect address or instructions
Additional fees may apply for redelivery.
8. Cancellations & Changes
Orders may be cancelled or modified under the following conditions:

More than 24 hours before delivery: Full refund or adjustment

Within 24 hours of delivery: Subject to a cancellation or rescheduling fee

After dispatch: Orders cannot be cancelled and are non-refundable
We reserve the right to cancel or modify orders due to operational, safety, or availability reasons.
9. Refunds
Due to the nature of bulk materials:

All sales are final once delivered

No refunds will be issued after material has been dumped

Refunds (if applicable) are issued at our sole discretion
10. Limitation of Liability
Cloverdale Topsoil Ltd. is not responsible for:

Damage to driveways, surfaces, or property during delivery

Improper use of materials after delivery

Delays caused by weather, traffic, or unforeseen circumstances
Our liability is limited to the value of the materials purchased.
11. Customer Responsibility
Customers are responsible for:

Confirming correct material selection

Providing accurate delivery details

Ensuring safe and legal placement of materials
12. Intellectual Property
All website content, branding, and materials are the property of Cloverdale Topsoil Ltd. and may not be used without permission.
13. Governing Law
These Terms & Conditions are governed by the laws of the Province of British Columbia, Canada.
